DMCA Takedown Policy

ToFans ("we", "us", or "our") respects the intellectual property rights of others and complies with the provisions of the Digital Millennium Copyright Act (DMCA). This policy outlines the process for submitting copyright infringement claims and how we address such claims.

1. Reporting Copyright Infringement

To file a DMCA takedown notice, the copyright owner or authorized agent must provide the following information to our designated agent:

Required Information

  • Identification of the copyrighted work:

    • A description of the work(s) claimed to be infringed.
    • Registration number(s) (if applicable).
  • Identification of the infringing material:

    • The specific URL(s) or location of the allegedly infringing content on our platform.
  • Contact information:

    • Your full name, mailing address, telephone number, and email address.
  • Good faith statement:

    • A statement that you have a good faith belief the use of the material is unauthorized by the copyright owner, its agent, or the law.
  • Accuracy statement:

    • A declaration, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
  • Signature:

    • A physical or electronic signature of the copyright owner or authorized agent.

2. Our Response to DMCA Notices

  • Review

    • We will review the notice for completeness and compliance with DMCA requirements.
  • Action

    • If the notice is valid, we will remove or disable access to the allegedly infringing content within 48–72 hours.
    • Monetization Impact: Payments to the creator associated with the removed content will be suspended pending resolution. Subscriptions/rewards tied to the content may be paused or refunded at our discretion.
  • Notification

    • We will notify the user who posted the content (if identifiable) and provide a copy of the DMCA notice.

3. Counter-Notification (Content Restoration)

If a user believes their content was removed in error, they may submit a counter-notification containing:

  • 1. Identification of the removed content and its original location.
  • 2. A statement under penalty of perjury that the removal resulted from a mistake or misidentification.
  • 3. Consent to jurisdiction related to this counter-notification under the governing law and dispute resolution mechanisms outlined in our Terms of Service Agreement.
  • 4. Their physical/electronic signature.

Upon receipt of a valid counter-notification:

  • We will forward it to the original complainant.
  • Content may be restored within 10–14 business days unless the complainant files legal action.
  • Monetization Impact: If restored, suspended payments may resume, but we are not liable for lost earnings during the takedown period.

4. Repeat Infringers

Users who repeatedly post infringing content may face:

  • Termination of their account.
  • Forfeiture of unpaid earnings.
  • Permanent suspension from monetization features.

5. Creator Responsibilities

By uploading content, creators warrant they own or have licensed all rights to the material. We reserve the right to withhold payments or recover funds if content is found infringing.
